A draft decree questions the suitable to training of kids with disabilities

While families have been denouncing for years the difficulties they encounter in finding a school for their child with disabilities, a draft decree puts the fire to the dust. If passed as is, it would indeed create a category of children “unable” to attend school, in stark contrast to the current approach to disability.

→ EXPLANATION. Education of children with disabilities: CNCPH is concerned about a draft decree

It all started with an a priori text far from the topic: the law against separatism, which, in the name of refusing to withdraw the identity, more strictly frames home schooling. From now on, to use it, every family will have to request authorization from the rectory.

The problem is that home schooling is the last resort that many families of children with disabilities turn to, not finding a satisfactory solution in school. “My son was homeschooled for six years, so testifies Marion Aubry, vice president of TouPI, the mutual aid association between parents. This is a very common situation, that of many children who have been promised an AVS (school life assistant, editor’s note) at the beginning of the school year, for example, but as of January they still don’t have one and drop it. »

“It is never impossible for a child to go to school”

From now on, parents will find it less easy to withdraw their children from school and secure the classroom themselves. They must present a medical certificate or a notice from the department house for disabled persons “impossibility”, for their child to be admitted to the regular school. This requirement can only be applied to all school years and in case of a problem during the year, the child must stay in the classroom.

This prospect is making many associations jump, which they see as a way for the state to clear customs. “A child never leaves school. It is National Education that does not provide the necessary tools to meet the specific needs of these children”. plague thus Bénédicte Kail, of the APF France handicap.

In fact, the legality of the decree seems very uncertain, admits Denis Berthiau, professor of health law at Paris-Descartes University. “Since the 2005 law, rights to education and disability compensation are the norm, he progresses. It is up to the state to ensure that every child can exercise his right to education, offering him the help he needs to compensate for his shortcomings, be it human or technical support. »

→ MAINTENANCE. Disability, “a war started at the beginning of schooling”

Beyond the law, if such a text were to see the light of day, it would also pose an ethical problem. “It would be segregative and restrictive, because it would send students with disabilities back to their families, who already have to deal with severe care, continues Emmanuel Hirsch, professor of ethics at the University of Paris-Saclay. This would be even more unacceptable as isolation has shown the importance of school in terms of socialization, as well as the burden of homeschooling on families. The state cannot throw itself in this way on those who already have more to endure. »
